These Terms apply to the website, Dominicargo app, shipments, pickups, quotes, payments, and logistics operations.
1. Acceptance of Terms
By accessing or using our services, you agree to these Terms and any shipment-specific conditions, pricing, or operational requirements presented before shipment acceptance, payment processing, or transportation.
If you do not agree to these Terms, you may not use the services.
2. Services
Dominicana Cargo Express provides logistics coordination, shipment handling, cargo transportation, pickup services, package delivery, and related operational services between the United States and the Dominican Republic.
Service availability, transportation routes, delivery schedules, pricing, and operational options may vary depending on destination, shipment type, customs processing, carrier availability, weather conditions, and other operational factors.
3. Eligibility
Users must be at least 18 years old to create accounts, submit shipments, authorize payments, or use our services.
By using the services, you represent that you meet this eligibility requirement.
4. Customer Responsibilities
Customers are responsible for providing accurate and complete:
- Sender and receiver information
- Addresses and contact details
- Shipment descriptions
- Declared contents and declared values
- Payment and billing information
Customers are solely responsible for ensuring that shipments comply with all applicable customs regulations, import/export laws, transportation restrictions, sanctions requirements, and local laws in all applicable jurisdictions.
5. Prohibited and Restricted Items
Customers may not ship prohibited, restricted, hazardous, illegal, flammable, explosive, perishable, counterfeit, or otherwise unauthorized items.
This includes any items restricted by:
- Transportation providers
- Customs authorities
- Airport or maritime regulations
- Applicable local, state, federal, or international laws
- Our operational policies
Additional restrictions may be listed in our Prohibited & Restricted Items Policy, which forms part of these Terms.
Dominicana Cargo Express reserves the right to refuse, inspect, reject, delay, return, report, or dispose of shipments containing prohibited or undeclared items where permitted by law.
6. Quotes, Pricing, and Payment
Pickup requests may be submitted without upfront payment.
Shipment pricing is reviewed and confirmed during the pickup, inspection, or intake process based on factors including:
- Shipment size
- Weight and dimensions
- Declared contents and value
- Destination
- Customs requirements
- Applicable operational or transportation conditions
Customers must review and accept applicable shipment pricing, service terms, and provide a valid payment method before Dominicana Cargo Express accepts, processes, or removes the shipment for transportation.
Payments, operational fees, customs-related charges, and shipping charges may become non-refundable once shipment processing, transportation preparation, or customs handling has begun.
7. Delivery and Tracking
Tracking information is provided for operational convenience and reference purposes only.
Estimated delivery times are not guaranteed and may be affected by:
- Customs processing
- Government inspections
- Weather conditions
- Transportation interruptions
- Carrier delays
- Port or airport congestion
- Operational limitations
- Events beyond our reasonable control
Dominicana Cargo Express is not liable for delays resulting from these circumstances.
8. Storage Fees and Abandoned Shipments
Shipments received at our Dominican Republic facilities that remain unpaid or unclaimed after 20 days may incur storage charges equal to 10% of the declared shipment value or other applicable operational storage fees.
Shipments remaining unpaid, unclaimed, or unresolved after 30 days may be considered abandoned to the extent permitted by applicable law.
Abandoned shipments may be sold, auctioned, destroyed, or otherwise disposed of to recover storage costs, transportation expenses, customs charges, operational fees, or other related expenses.
9. Fragile or Improperly Packaged Shipments
Dominicana Cargo Express is not responsible for damage involving fragile, breakable, temperature-sensitive, perishable, improperly packaged, or insufficiently protected items unless packaging services were directly provided by Dominicana Cargo Express.
Customers are responsible for ensuring shipments are appropriately packaged for transportation and handling conditions.
10. Declared Contents and Customs Compliance
Customers are responsible for accurately declaring all shipment contents and declared values.
Claims, reimbursement requests, shipment protection coverage, or insurance-related requests may be denied for shipments involving:
- Undeclared items
- Concealed items
- Misrepresented contents
- Understated values
- False declarations
- Attempts to avoid duties, taxes, inspections, or customs restrictions
Customers may also be responsible for resulting fines, penalties, confiscations, or legal consequences arising from inaccurate declarations.
11. Shipment Claims and Reimbursement Limits
Claims for missing, damaged, or incomplete shipments must be submitted within 7 calendar days after delivery.
Approved reimbursement, shipment protection, or operational compensation claims are limited to a maximum of USD $200 per box, barrel, or shipment unit unless additional declared protection coverage was separately approved in writing.
All claims are subject to shipment verification, operational review, declared contents validation, compliance with these Terms, and internal claim approval procedures.
Dominicana Cargo Express reserves the right to request supporting documentation, photos, receipts, or proof of value before reviewing any claim.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Dominicana Cargo Express shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the use of the services.
Dominicana Cargo Express is not responsible for losses, delays, seizures, inspections, customs holds, confiscations, government actions, regulatory enforcement actions, transportation interruptions, acts of nature, or events beyond our reasonable control.
Total liability for any approved claim shall not exceed the applicable reimbursement limits described in these Terms.
13. Account Suspension and Refusal of Service
We reserve the right to suspend accounts, refuse service, reject shipments, cancel transportation requests, delay processing, or deny claims when users violate:
- These Terms
- Applicable laws or regulations
- Customs requirements
- Payment obligations
- Operational or security policies
We may also take action where shipment activity appears fraudulent, unsafe, abusive, misleading, or operationally prohibited.
14. Intellectual Property
All website content, app content, branding, logos, graphics, software, operational materials, text, and related intellectual property are owned by Dominicana Cargo Express or its licensors and may not be copied, reproduced, distributed, modified, or reused without prior written permission.
15. Governing Law
These Terms shall be governed and interpreted in accordance with the laws of the State of New York and applicable laws of the Dominican Republic where operationally or legally required.
16. Changes to These Terms
We may update these Terms from time to time by posting revised versions on this page with an updated effective date.
Continued use of the services after updated Terms become effective constitutes acceptance of the revised Terms.
